One of the many services we provide to elder law clients is in Medicaid planning to protect family assets, while qualifying for Medicaid benefits. We work with clients to develop successful Medicaid plans, involving such techniques as developing a legitimate asset spend down strategy, creating and transferring assets to irrevocable trusts and purchasing Medicaid compliant annuities. In addition to Medicaid planning, we also provide assistance in post-death planning to lawfully protect assets from the Pennsylvania Estate Recovery Program, which allows the Commonwealth of Pennsylvania to obtain reimbursement from the estate of a deceased family member who has received Medicaid benefits in their lifetime as an older adult.
On occasion, court action is necessary to protect the rights of our elderly, such as guardianship proceedings where an elderly individual may be incapacitated, or a civil lawsuit on behalf of an elderly person to protect them from financial exploitation.
