Whether you are buying or selling real estate, we are here to represent your interests. We will assist you in negotiating, preparing or reviewing Agreements of Sale, as well as in representing your interests in the sale or purchase of real estate. If you are buying or selling property, you may have been told that you do not “need” a lawyer. Further, if you are buying property, you have probably been offered a “convenient” one-stop package deal in which everything is handled through the office of your realtor, or by affiliated companies. These arrangements present the potential for conflicts of where no one is looking out for you.
For most individuals, the purchase of real estate is the most significant financial investment they will undertake in their lives. You owe it to yourself and your family to have an independent, experienced lawyer protect your financial investment and your new home. The purchase of real estate is too important to be left to chance, or to the advice of individuals who have, or may have, a conflict by virtue of their financial stake in your purchase of real estate, or by having interconnected financial interests with others.
In a real estate transaction, you should have an attorney representing you at the outset to review the Agreement of Sale and in all later stages of the transaction, including the closing (settlement) itself. Even if you do not contact us until after you have signed an Agreement of Sale, we can still represent you in the closing (settlement). Most mortgage lenders will require title insurance, and even if you are not financing your purchase with a mortgage, generally you should still have title insurance. Attorney Fries is an approved attorney who is able to handle your title insurance needs.
If you are selling or considering selling your real estate without a realtor, our office can also represent you in the drafting of an Agreement of Sale and in representing your interests through the settlement of the property, for an agreed upon flat fee. We have successfully represented several “for sale by owner” clients.
Our experienced attorneys also handle all other areas of real estate, such as easement or right-of-way disputes, quiet title actions, deed transfers and mortgage agreements. We are experienced litigators in handling real estate disputes in the civil courts on those occasions when legal action is necessary to protect your real estate interests.
